Are Office Commute Accidents Covered Under ESI Benefits?
Yes — if job related. Under Section 51E of the ESI Act, accidents during travel to and from work are treated as employment injuries where there is a clear nexus with employment. This makes the employee (or dependents) eligible for compensation and protection even outside office premises.
Who Is Covered?
Employees with monthly wages of ₹21,000 or below in an ESI-registered organisation that pays contributions regularly. The scheme extends medical care and financial assistance to workers and their dependents in case of sickness, injury, or disability.
Accident Reporting Time
Employers must submit an Accident Report to the Branch Office/ESI Dispensary within 24 hours in case of death or disablement. Minor accidents not leading to absence from work need not be reported.
Accident Benefits Under ESIC
- Accident Benefit: 100% of average daily wages in case of disablement due to employment injury, provided contributions for 78 days are paid in the contribution period.
- Sickness Benefit: 70% of average daily wages in cash during medical leave, up to 91 days in two consecutive benefit periods.
- Artificial Limb Cases: 100% wages apply during admission in a limb centre for fixation/repair/replacement.
Accident Book Requirement
Every employer must maintain an accident book in the prescribed format to record incidents causing personal injury to insured persons. Each book must be preserved for five years from the last entry date.
