Penalty under the Act: Section 85(a): Penalty for failure to pay contribution
Non-payment of this contribution is a serious offense because it directly affects insurable employees. Hence, the maximum imprisonment for this offense is 3 years and the minimum is 6 months with Rs. 5,000 as fine.
Applicable to which State: All the States and Establishments covered by the ESI Act

Pertains to: shall come into force in all the areas of the 7 non-notified districts i.e. Almora, Bageshwar, Chamoli, Champawat, Pithoragarh, Rudraprayag and Uttarkashi districts, in the State of Uttarakhand.

And in this instance: In exercise of the powers conferred by sub-section (3) of section 1 of the Employees’ State Insurance Act, 1948 (34 of 1948), the Central Government hereby appoints the 1st day of December, 2023, as the date on which the provisions of the said Act, namely —
- sections 38 to 43 and sections 45A to 45H of Chapter IV;
- (ii) sections 46 to 73 of Chapter V;
(iii) sections 74, 75, sub-sections (2) to (4) of section 76, 80, 82, and 83 of Chapter VI shall come into force in all the areas of 7 non-notified districts i.e. Almora, Bageshwar, Chamoli, Champawat, Pithoragarh, Rudraprayag, and Uttarkashi districts, in the State of Uttarakhand.
