The Department of Industry, Energy, Labour and Mining, Maharashtra, has issued a notification regarding draft amendments to the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017.

Key Highlights of Governance Process Re-engineering (GPR)

  • Simplification of government processes and reduction in delays.
  • Enhanced efficiency, transparency, and citizen-centric services.
  • Promotion of e-governance with online access and reduced paperwork.
  • Reform in registration and intimation services under the Act.
  • Reduction in documentation and information requirements.
  • Time limit reduced from seven working days to one working day.
  • Restructuring of ownership and rental details.
  • Expanded options for proof of establishment.
  • Additional requirement for address proof in the schedule.

Changes in Form A

Certain entries have been deleted to simplify compliance:

  • Entry 5: Additional workplace address
  • Entry 14: Employer’s family members employed
  • Entry 15: Management and confidential staff details
  • Entry 17: Authorised person and manager details

Revised Entry 18:

Ownership declaration simplified into structured Yes/No format for owned and rented premises with owner/lessor details.

Updated Document Requirements

For New Registration (Form A)

Proof of establishment can include:

  • Sale or purchase deed
  • Property tax receipt
  • Electricity bill
  • Society maintenance receipt
  • 7/12 extract
  • 8A issued by local authority

For Intimation (Form F)

Proof of establishment address includes similar documents as above.

Previous Amendment – 2025 Overview

The 2025 amendment focused on easing compliance while maintaining employee protection.

Working Hours

  • Spread-over increased from 10.5 to 12 hours.
  • Continuous work limit increased from 5 to 6 hours.

Overtime and Night Shifts

  • Quarterly overtime increased from 125 to 144 hours.
  • Strengthened provisions for women working night shifts.

Compliance Forms

  • Form H: Establishments with less than 20 workers
  • Form J & K: Business closure intimation
  • Form L: Women’s consent for night shifts
