Penalty under the Act

Penalties – 1 [Whoever contravenes any of the provisions of Section 7 to 11, 13 to23, 25, 26, 29 to 41, and 47 shall be punishable for a first offense, with a fine which may extend to five thousand rupees and for a second or subsequent offense, with fine which may extend to ten thousand rupees.] 2 [45A. Penalty for failure to comply with the provisions of section 41-A– Any employer who fails to comply with the provisions of Section 41-A shall be punishable with imprisonment for a term which may extend to six months, or with a fine, or with both and where such failure is a continuing one, with a further fine which may extend to two hundred rupees for every day during which such failure continues after the conviction for the first and the court trying the offense, if it finds the offender, may direct that the whole or any part of the fine realized from him shall be paid, by way of compensation, to any person who, in its opinion has been injured by such failure.

And in the current instance: The government of Tamil Nadu has notified the Tamil Nadu Shops and Establishments (Amendment) Act, 2023. This Amendment Act seeks to further amend the Tamil Nadu Shops and Establishments Act, of 1947. The Act will come into force on the date that will be appointed by the government.

Adequate Number of Latrine and Urinals

Every employer shall provide a sufficient number of latrines and urinal accommodations. These shall be conveniently situated so that they are accessible to the employees at all times during working hours.

Appropriate Restroom and Lunchroom

Every employer shall provide adequate and suitable rest rooms and lunch rooms. These rooms shall also have a provision for drinking water for the employees. The rooms shall be sufficiently ventilated and lighted and shall be maintained in a clean and tidy condition. They shall also be furnished with chairs or benches with backrests.

First-aid

Every employer shall provide first-aid facilities at the place of work.
