And in this instance: The Employees State Insurance Corporation on February 8, 2023, issued a judgment stating that section 1 (6) of the ESI Act shall be applicable irrespective of the number of persons employed at any time falls below the limit specified by or under the Act.
The following has been observed by the APEX Court vide order dated January 20, 2023, in the matter of ESIC versus Radhika Theatre.
ESIC act shall be applicable even with respect to those establishments established prior to 31/3/1989 / 20/10/1989 and the ESIC act shall be applicable irrespective of the number of persons employed or notwithstanding that the number of persons employed at any time falls below the limit specified by or under the ESI Act
