Relating to which Act: The Factories Act, 1948 and Environment Protection Act 1986 

Penalty under the Act: Section 96A of the Factories Act, 1948 defines the penalty for the contravention of certain provisions, such as Sections 41B, 41C, and 41H. Anyone who disobeys or violates any of the rules or the provisions of Sections 41B, 41C, or 41H will be sentenced to 7 years in prison and a fine of Rs. 2,00,000.

WHEREAS, the Ministry of Environment, Forest & Climate Change (MoEF&CC) has notified Plastic Waste Management Rules, 2016, in exercise of the powers conferred under sections 3,6 & 25 of the Environment (Protection) Act, 1986 vide Notation No. GSR 320 (E) dated March 18, 2016; and

WHEREAS, the MoEF&CC amended PWM Rules 2016 vide Notification No. G.S.R 285

(E) dated March 27, 2018; and

WHEREAS, Guidelines on Extended Producer Responsibly (EPR) for Plastic Packaging were notified by MoEF&CC on 16 February, 2022 in Schedule – II of 4th amendment of Plastic Waste Management Rules, 2016; and

WHEREAS, as per section 6.1(a) of the above Guidelines, the following entities shall register on the centralized portal developed by Central Pollution Control Board namely (i) Producer (P): (ii) Importer (I); (iii) Brand owner (BO); (iv) Plastic Waste Processor engaged in (a) recycling, (b) waste to energy, (c) waste to oil, and (iv) industrial composting; and
