Penalty under the Act: Section 85(a): Penalty for failure to pay contribution
Non-payment of this contribution is a serious offense because it directly affects insurable employees. Hence, the maximum imprisonment for this offense is 3 years and the minimum is 6 months with Rs. 5,000 as fine.

And in this instance: The ESI Corporation on June 26, 2023 issued a notification regarding the Fire Safety Compliance / Fire NOC.
The following has been stated:
The fire safety audit and disability audit have to be conducted of all ESI Hospitals by any Government Institution and has directed to take necessary action for obtaining fire NOC in respect of ESIC establishments.
It will be the responsibility of the Estate Officer / concerned authority to ensure all necessary actions are complete, all licenses obtained and all EST buildings are fire safety compliant.
