The government of Maharashtra extends ESIC to casuals in municipal bodies where 10 or more are employed

Relating to which Act: The Employees’ State Insurance (ESI) Act, 1948          

Penalty under the Act: Section 85(a):  Penalty for failure to pay contribution Non-payment of this contribution is a serious offence because it directly affects insurable employees. Hence, the maximum imprisonment for this offence is 3 years and the minimum is 6 months with Rest. 5,000 as fine.

Applicable to which State: All the States and Establishments covered by the ESI Act

Type: Public Health Department Notification No. Rakayo 2021 / Pra / Kra / 130 / Rakavi 2 dated 27/7/2023 issued by Joint Secretary to Government

Pertains to: Municipal bodies including Municipal Corporation (Nagar Nigam), Municipal councils, Nagar Palika & Other Urban Local Bodies run by State Government

And in this instance: The Government of Maharashtra in consultation with the Employee’s State Insurance Corporation and with the approval of the Central Government, after having given months’ notice as required by said sub-section (5), hereby appoints the 1st August 2023, to be the date on which all the provisions of the said Act shall extend to the classes of establishments mentioned in column (2) of the Schedule appended hereto wherein ten or more persons are employed, Municipal bodies including Municipal Corporation (Nagar Nigam), Municipal councils, Nagar Palika & Other Urban Local Bodies run by State Government wherein 10 or more persons on casual or contractual or both, basis are employed or were employed for wages on any day of the preceding twelve months

Subject: The Government of Maharashtra in consultation with the Employee’s State Insurance Corporation and with the approval of the Central Government, after having given months’ notice as required by said sub-section (5), hereby appoints the 1st August 2023, to be the date on which all the provisions of the said Act shall extend to the classes of establishments mentioned in column (2) of the Schedule appended hereto wherein ten or more persons are employed,
