Penalty under the Act : 25. Penalties.- Subject to the other provisions of this Act, whoever contravenes any of the provisions of this Act or the rules made thereunder and no penalty has been provided for such contravention in this Act, shall be liable, on conviction, to a fine which shall not be less than one thousand rupees but which may extend to five thousand rupees for the first offence, and not less than three thousand rupees but which may extend to eight thousand rupees for every subsequent offence

And in the current instance: In supersession of previous notifications of this Department regarding opening and closing hours and in pursuance of the provisions contained in section 9 of the Himachal Pradesh Shops and Commercial Establishments Act, 1969 (Act No. 10 of 1970), the Governor of Himachal Pradesh is pleased to extend the closing hours of Shops and Commercial Establishments in the State of Himachal Pradesh covered under the said Act from 9:00 P.M. to 11:00 P.M. with immediate effect, till 31-07-2023, subject to applicability of other provisions of Act ibid and other applicable labour laws.
And in the last instance: The Government of Himachal Pradesh is pleased to exempt all shops and commercial establishments, during celebration of the New Year and due to heavy rush of tourists, w.e.f. 28-12-2022 to 02-01- 2023 till 12.00 P.M. midnight, from the Sections 8, 9 and 10 of the said Act in Himachal Pradesh, in public interest.
Let us look at section 8, 9 and 10 of the said act: 8. Intervals for rest or meals. – (1) Subject to the provisions of section 6, no employee except a chowkidar, watchman or guard, shall be allowed to work in an establishment for more than five hours before he has had an interval for rest of at least half an hour:
- Opening and closing hours. – The Government shall, by notification, fix the opening and closing hours of all classes of establishment
- Close-day. -, every establishment shall remain close on such day in a week as may be prescribed:
