Now, all sexual harassment complaints within Delhi govt have to go online

Relating to which Act: The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressed) Act of 2013 (POSH Act),

Penalty under the Act: Failure to comply with this could lead to hefty penalties. Some of the provisions under the PoSH Law include: When the employer fails to constitute an Internal Committee or breaches provisions of this Act or any rules made thereunder, they shall be punishable with fine of fifty thousand rupees (INR 50,000).

Applicable to which State: Whole of India

Type: The directions came after the WCD Minister Atishi, reacting to complaints of sexual harassment against a suspended deputy director, WCD Premoday Khakha who allegedly raped a minor in his care at his house

Pertains to: All establishments where the act is applicable – APPLICABILITY OF THE POSH provisions are applicable to all establishments, companies, organization’s (whether public or private) employing 10 or more employees (whether permanent, temporary, ad-hoc, consultants, interns or contract workers irrespective of gender) irrespective of business or industry.

The directions came after the WCD Minister Atishi, reacting to complaints of sexual harassment against a suspended deputy director, WCD Premoday Khakha who allegedly raped a minor in his care at his house, asked that a system be created to strengthen Internal Complaints Committees (ICCs) and identify officers having repeated cases of sexual harassment complaints against them

COMPLIANCES UNDER POSH

(1) Constitution of Internal Complaints Committee

(2) Formulation of Internal POSH Policy

(3) Organizing Workshops, Awareness Programs and Orientation Programs.

(4) Submission of Reports

 

COMPLAINT OF SEXUAL HARASSMENT

  1. Any aggrieved women can make a complaint in writing about the sexual harassment at workplace to Internal Complaints Committee on this from the date of incident.
  2. Where the aggrieved women are unable to make a complaint on account of her physical, mental incapacity or death or otherwise, her legal heir may make a compliant.
  3. The Internal Committee or the Local Committee may before be initiating an inquiry under section 11 and at the request of the aggrieved women take step to settle the matter between her and the respondent through conciliation.
  4. If the matter is settled, the Internal Committee or the Local Committee will take into records and forward the same to employer or district officer to take further action.
  5. When settlement is arrived, no further inquiry shall be conducted by the Internal Committee or the Local Committee.

Officials said training has not started yet but UTCS has been doing training on sexual harassment for a long time.    

Any complaints of sexual harassment within the Delhi government will now have to be logged online, instead of on paper, within a week to ensure transparency, as per directions of Chief Secretary Naresh Kumar.

The directions came after the WCD Minister Atishi, reacting to complaints of sexual harassment against a suspended deputy director, WCD Premoday Khakha who allegedly raped a minor in his care at his house, asked that a system be created to strengthen Internal Complaints Committees (ICCs) and identify officers having repeated cases of sexual harassment complaints against them.

Following this, the CS had ordered that members of ICCs be trained on how to deal with cases of sexual harassment. The Special Director, Union Territories Civil Services (UTCS), has been asked to arrange training sessions for members of ICCs within a month.

Officials said training has not started yet but UTCS has been doing training on sexual harassment for a long time.
