Tamil Nadu shops and establishments to remain open for 365 days

Penalty under the Act: Tamil Nadu Shop – 45. Penalties – 1 [Whoever contravenes any of the provisions of Section 7 to 11, 13 to23, 25, 26, 29 to 41 and 47 shall be punishable for a first offence, with fine which may extend to five thousand rupees and for a second or subsequent offence, with fine which may extend to ten thousand rupees.]

Tamil Nadu Rules –  11. Fines. —(1)(a) 2 [The Commissioner of Labour and the Deputy Commissioners of Labour I and II, Madras, Salem, Coimbatore, Madurai, Tiruchirappalli and Tirunelveli] shall be the authority competent to approve, under sub-section (1) of section 35, acts and omissions in respect of which fines may be imposed and under sub-section (8) of section 35, the purposes to which the fines realised shall be applied. (b) Every employer requiring the power to impose fines in respect of any acts and omissions on the part of employed persons shall send to the Commissioner of Labour or to the Deputy Commissioner of Labour having jurisdiction over the area-

In exercise of the powers conferred by Section 6 of the Tamil Nadu Shops and Establishments Act, 1947 (Tamil Nadu Act XXXVI of 1947) and in continuation of the Labour and Employment Department Notification No. II(2)/LE/216/2020, published at Pages 1-2 of Part II —Section 2 of the Tamil Nadu Government Gazette Extraordinary, dated the 23rd March 2020, the Governor of Tamil Nadu, in public interest, hereby exempts all establishments from the provisions of sub-section (1) of Section 11 of the said Act and permits all the establishments in the State of Tamil Nadu to keep open on all 365 days of the year, for a further period of three years with effect from the 23rd March 2023, unless it is revoked, subject to the following conditions,
