Relating to which Act: The Act replaces the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.

The Rights of Persons with Disabilities (RPwD) Act, 2016, enacted on 28.12.2016 and came into force from 19.04.2017,   Maharashtra State Rights of Persons with Disabilities Rules 2023

Penalty under the Act: Penalties for offences

The Act provides for penalties for offences committed against persons with disabilities and also violation of the provisions of the new law.

Any person who violates provisions of the Act, or any rule or regulation made under it, shall be punishable with imprisonment up to six months and/ or a fine of Rs 10,000, or both. For any subsequent violation, imprisonment of up to two years and/or a fine of Rs 50,000 to Rs five lakh can be awarded.

Whoever intentionally insults or intimidates a person with disability, or sexually exploits a woman or child with disability, shall be punishable with imprisonment between six months to five years and fine.

Special Courts will be designated in each district to handle cases concerning violation of rights of PwDs.

And in the current instance : And whereas copies of the said notification were made available to the public on the 2nd June, 2023; And whereas the objections and suggestions received from the public in respect of the said notification have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by sub-sections (1) and (2) of section 100 of the Rights of Persons with Disabilities Act, 2016 (49 of 2016), the Central Government hereby makes the following rules further to amend the Rights of Persons with Disabilities Rules, 2017, namely:-

(1) These rules may be called the Rights of Persons with Disabilities (Amendment) Rules, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Rights of Persons with Disabilities Rules, 2017, in rule 15, in sub-rule (1), after clause (g), the following clause shall be inserted, namely: – “(h) rural sector specific harmonized accessibility standards/guidelines, as specified in the notification of the Ministry of Rural Development, Government of India vide notification number G.S.R. 77, dated the 26th June, 2023.”
