What is the service about ?

As per the Economic Census of Central Statistical Office done in the recent past, there are about over 7.00 crore establishments in agricultural and non-agricultural sectors combined who are required to maintain registers related to details of employees, their salaries, loans/recoveries, attendance, and so on

All put together, there are about 56 different types of registers to be maintained, with about 933 fields where a variety of data is required to be tabulated for the purpose of scrutiny by authorities as and when needed with a view to ensuring that employee-related benefits are being paid to the employees/workers engaged by various enterprises, irrespective of direct or indirect.

Some of the Labour laws registers that are required to be maintained include The Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, The Contract Labour (Regulation and Abolition) Act, 1970, The Equal Remuneration Act, 1976 The Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979, The Minimum Wages Act, 1948, The Payment of Wages Act, 1936, The Sales Promotion Employees (Conditions of Service) Act, 1976.

Besides the above, the Employment Exchanges (Compulsory Notification Of Vacancies) Act, 1959 And Rules, 1960 also calls for Submission of Quarterly Return in ER-I to be submitted to Local Employment Exchange for Quarter ending March, June, September, and December. – FORMER I (Within 30 Days). There is also the Apprenticeship Act of 1961 which entails filing online returns for imparting apprenticeship training. As of 18th May 2020, the Government identified about 261 Designated Trades and 336 Optional Trades across 37 industry sectors available for apprenticeship training which as per rule covers all establishments having a workforce (regular and contract employees) of 30 or more are mandated to undertake Apprenticeship Programs in a range from 2.5% -15% of its workforce every year.

With the ease of doing business, a competitive model has already been brought into force by the Government in order to further simplify the pressure of maintenance of statutory registers individually by various establishments, small, medium, and large, the Government has, for the purpose of expedient compliance of the requirements of various labour-related laws, combined a set of registers for all such laws in some states only. And whereas the intention to provide such combined register has been to sub-serve the purposes, more specifically electronically, of the said labour related laws and the Rules made thereunder, wherein provisions have been made for the maintenance of such registers;

And whereas combined registers provided under the proposed rules will facilitate ease of compliance, maintenance and inspection, and will also make the information provided thereunder easily accessible to the public through electronic means thereby increasing transparency; And whereas making separate rules for the aforementioned purpose will benefit making references of registers provided under different labour related laws simple, which will serve a public purpose in a better way;

These combined registers can be maintained electronically. If the registers were already maintained in electronic format, then as per sub-rule 3 of rule 2 of the Rules, the layout and presentation of the register should be adjusted without changing the integrity, serial number, and contents of the column of the register.
